Abstract
This study aims to analyze the legal responsibilities of orthopedic surgeons in performing Minimal Invasive Surgery (MIS) on BPJS Kesehatan patients within the framework of the National Health Insurance (JKN) system. While MIS offers advantages such as reduced tissue trauma and faster recovery, its implementation in Indonesia faces challenges such as limitations in facilities and medical resources within the JKN system. This research employs a normative method with a literature review and analysis of legal documents, including the Medical Practice Law and the Indonesian Civil Code on malpractice. The study found that orthopedic surgeons have significant legal responsibilities, including the obligation to provide clear information to patients and obtain valid informed consent. Systemic constraints in JKN can increase the risk of medical complications and legal claims. Therefore, strengthening supervision and training is essential to minimize legal risks and ensure the quality of medical services.
